By accessing or using itopsintelligence.com (the "Site"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Site. These terms apply to all visitors, users, and others who access the Site.

2. Description of services

ITOps Intelligence™ is a publishing imprint of TMG Global Service, Inc. We publish the ITOps Intelligence™ executive IT operations book series and provide consulting advisory services to state government and private sector organizations. The Site provides information about these services, a waitlist signup, a newsletter subscription, a blog, and a merchandise shop.

3. Intellectual property

All content on this Site — including text, design, graphics, logos, icons, and code — is the property of TMG Global Service, Inc. and is protected by United States and international copyright law. You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content from this Site without express written permission from TMG Global Service, Inc.

The ITOps Intelligence™ book series content, frameworks, checklists, and materials are protected by copyright. Unauthorized reproduction of book content is prohibited.

4. Trademark rights

ITOps Intelligence™ is a pending trademark of TMG Global Service, Inc. (US application filed April 13, 2026, Classes 016 and 042). International trademark applications are pending under the Madrid Protocol (WIPO).

You may not use the ITOps Intelligence™ name, logo, or marks in any way that could cause confusion, imply endorsement, or suggest affiliation without express written permission. Unauthorized use is prohibited under 15 U.S.C. §1125(a) and applicable trademark law.

5. Permitted use

You may access and use the Site for lawful personal and commercial informational purposes. You may share links to the Site. You may quote brief excerpts from blog content for commentary, criticism, or news reporting, provided you clearly attribute the source.

6. Prohibited conduct

You may not:

Use the Site for any unlawful purpose
Attempt to gain unauthorized access to any part of the Site or its systems
Scrape, crawl, or harvest data from the Site in bulk without permission
Transmit malware, viruses, or other harmful code
Use the ITOps Intelligence™ mark or any confusingly similar mark
Reproduce or distribute book content without authorization
Impersonate TMG Global Service, Inc. or ITOps Intelligence™
Submit false or misleading information through any form on the Site

7. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.

Content on this Site is for informational purposes only. Consulting services are provided under separate engagement agreements. Nothing on this Site constitutes legal, financial, or professional advice.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TMG GLOBAL SERVICE, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total liability for any claim arising from these terms shall not exceed $100.

9. Indemnification

You agree to indemnify, defend, and hold harmless TMG Global Service, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of another party.

10. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado. You waive any objection to such jurisdiction and venue.

11. Changes to these terms

We may update these Terms of Use at any time. When we do, we will update the "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.
